Controlling economic crime and corruption in the business environment: »Concealment of offenders is an anomaly to the rule of law«

In the spirit of modern business developments with the increasing problem of corruption and economic crimes, on December 10, at the Faculty of Economics (EF), a consultation on Control/Management of economic crime and corruption in the business environment was held.
According to the organizers, the Commission for Prevention of Corruption (CPC), the Supreme State Prosecutor’s Office, Faculty of Security Studies (UM) and the Faculty of Economics (UL), there is no coincidence that the event was held on International Human Rights Day and on the day after the anniversary date of signing the United Nations Convention Against Corruption.
The experts present at this event were unanimous that the problem of corruption and economic crime stems from ignorance and the lack of understanding of ethical and moral principles. As Vesna Žabkar said corruption represents a threat to stability and security of society. Liljana Selinšek from the CPC said that the theme of corruption is topical because it affects all environments where the money flows, which in turn affects society.

gor Pribac from the Faculty of Arts believes that we are insufficiently devoted to the understanding and interpretation of the concept of ethics, particularly business and public ethics which are superior to the legal standards with informal sanctions and social convictions. In the process of society ethicisation, he mentioned currently publicly most exposed persons, the whistleblowers: Julian Assange and Edward Snowden, who spread news of immoral behavior.
Bećir Kečanović said that the risk of corruption is connected with general crime: »With fickleness and weak-mindedness, we won’t win this battle. There are no shortcuts! It is necessary to roll up our sleeves and restore order.« As stated by Ciril Keršmanec, due to uncertainties and misunderstandings in the time period between 2008 and2012, almost 60% of all complaints against legal persons for economic crime were discarded. Therefore, the public prosecutors are key players in the fight against corruption. Zvonko Fišer highlighted the fact that the policy enforcement is in the hands of the public prosecutor’s office, because it is more of a technical than a political issue. It should be proactive and cooperate with law enforcement authorities and the society, without the presence of competition, but with cooperation in interdisciplinary: »concealment of offenders is an anomaly to the rule of law.«
Bojan Dobovšek described the European research project ARIEL, which deals with detection of factors that allow the entry of organized crime into legal economy. Sergeja Slapničar furthermore described the importance of the Supervisory Board: »The system of control in the company must try to reduce frauds and this is the role of the Supervisory Board.« With hopes of escaping the current situation in Slovenia, Adriana Rejc Buhovac presented successful examples of business efficiency in the USA and Canada, based on an integrated approach of promoting accountability. It is necessary to face potential risks and to be responsible leaders. Slovenia can recover if it is strong enough in the fight against corruption and organized crime with an understanding of ethical principles.
